DUI accident, DUI classes – Accidental trouble?
Driving under the influence or DUI is commonly defined as attempting to operate a vehicle under the influence of alcohol, drugs or both of the given substances. No matter what substance –whether alcohol or drugs –that the suspect used to cause the offense, having this kind of crime –driving under the influence – still have great potential in causing serious injuries as well as having extensive damages to properties. In most jurisdictions, DUI (or driving while intoxicated, DWI, is synonymous to DUI and is being used in some states) is commonly charged as misdemeanor. But this can be charged to a person if there has been aggravating factors that are present and if the convicted person has multiple offenses already in a certain span of time.
The so-called aggravating factors include the following: having extensive damages to one’s property that was caused by DUI accidents, there is a child inside the vehicle during the offense and having BAC (blood alcohol concentration) that is higher than the approved legal limit. When a person knows the different consequences caused by accidents due to driving under the influence, they will realize and will understand that such crime should be avoided in order to save lives, properties and even the life of a person in general.
Bodily Injuries caused by DUI accidents
In most states, there are special provisions that are present in DUI laws which allows the assigned judge (in a particular case) to impose higher kinds and stricter sanctions to those people who have violated the law and have caused different bodily injuries due to driving under the influence. The said bodily injuries are usually the serious ones that’s why the state should not take for granted cases such as this. Some of the serious injuries includes having collapsed lungs, broken bones and even paralysis to those people who were harmed during the accident. When the stricter and harsher penalties has been implemented by the court, it is now possible for the offenders to have sanctions such as increased financial penalties or fines, have a longer terms in jail, longer duration of the suspension of driver’s license or license being revoked, longer periods of being under a probation and having an increased requirements for the insurance as well as in the alcohol evaluation and treatment. Those strict sanctions will make the roads safer from any accidents that are usually caused by DUI.
DUI Fatalities and Accidents
There are some state who are implementing provisions which are allowing prosecutors to charge those drivers who have vehicular manslaughter as well as in driving under the influence whenever there are fatalities present which was caused by reckless drivers who are unable to take a full control of his or her own vehicle. A lot of factors can greatly affect and influence the charges caused by a DUI offense which includes too much BAC (blood alcohol concentration) and other serious crimes that are being committed while there is still an offense that is in process and in prior to other DUI convictions as well as in other circumstances.
Some of the criminal penalties that are being mandated by the court is having fines, suspension of one’s driver’s license and obligatory attendance in DUI classes (which is quite expensive and is not being handled by the state). Every person should know that to every action, certain consequences proceeds.
